The current Russian legislation establishes compulsory land valuation for the following transactions in land: 

  • sale of undeveloped land parcels at public auctions;
  • contribution of land to the charter capital;
  • determining the ground rent rate for land in state or municipal ownership;
  • land requisitioning;
  • setting the buy-out price for land withdrawn for state or municipal needs.
Although in the case of a sale transaction or implementation of construction projects land valuation is not compulsory, it is also highly sought after. 
Land valuation is based on the principle of highest and best use. This means that the market value of a land parcel is determined on the basis of the use which is the most probable, physically possible, reasonable, legally permissible, financially feasible, and results in the maximum value estimate for the parcel. A land parcel can be reasonably subdivided into several lots with different forms, types and patterns of use. The highest and best use of a land parcel may or many not be the current use of the parcel.
The considerations to be taken into account when determining the highest and best use of a land plot include:
  • intended and permitted uses;
  • prevailing land uses in the nearest neighborhood;
  • anticipated changes in the land market;
  • existing use of the parcel.
